On February 25, 2019 public hearings started for the draft recommendation by the Board of the Eurasian Economic Commission (EEC) determining the order of interaction of the public oversight (supervision) authorities and customs bodies regarding prevention of putting the goods that do not meet the norms of the technical regulations of the Eurasian Economic Union (EEU) into trade.
According to the draft recommendation the public oversight (supervision) authorities in the event of violations are revealed shall be required to provide the customs bodies with the following information:
- name of the public oversight (supervision) authority that detected the imported products non-conforming to the requirements of the technical regulations of EEU;
- date and place of non-compliant products detection;
- details of the shipping documentation;
- details of the products specifying the violations revealed;
- information on the manufacturer (representative authorized by a manufacturer, vendor/importer) of the imported products;
- information on the certificates, declarations of conformity, certificates of the state registration for the products imported;
- data on the measures taken by the public oversight (supervision) authority with regard to the products imported.
Having received such information, the customs bodies pursuant to the current legislation can effectively suppress trade of non-compliant products in the EEU countries.
The customs bodies, in their turn, will transfer information on unsafe products to the public oversight (supervision) authorities. The public oversight (supervision) authority based on the information received will be required within 5 working days to hold an inquiry, the results of which will be sent back to the customs authorities.
